Government Asks Cort To Compel Tambuwal To Remove Defected APC Lawmakers

The Federal Government has asked an Abuja Federal High Court to pressure the Speaker of the House of Representatives, Aminu Tambuwal, to sack the lawmakers who had defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).

On March 31, the Federal High Court in Abuja ordered 37 former members of the PDP to resign their seats at the House for defecting to the APC. Justice Adeniyi Ademola held that the defected lawmakers no longer had any business, morally and legally, to stay in the House.

Despite the appeal, however, the FG insists that Tambuwal should be restrained from allowing the decampees to participate in the activities of the House.
A suit has been filed by Ade Okeaya-Inneh (SAN), Fabian Ajogwu (SAN) and Solomon Umoh (SAN) on behalf of the Attorney General of the Federation and Minister of Justice, Mohammed Bello Adoke (SAN). The defendants in the suits are the House of Representatives and the Speaker.
Citing a range of legislative acts and sections of the Constitution, the FG argues in its suit that at the moment the House of Representatives is not properly constituted and as such cannot lawfully exercise its general legislative powers and functions.
The FG also argues that as the decampees still participate in the House sitting, the House and its Speaker, cannot lawfully count the votes or presence of the persons for purposes of determining if a bill is carried or not, and for purposes of quorum of the House or its committees.
It will be recalled that the 37 lawmakers joined the opposition in December over "division and factionalisation" within the ruling PDP.
